CONDITIONS OF STAY
ALL GUESTS ENTER THESE PREMISES AT OWN RISK
All vehicles parked at own risk.
The Owners of Stellenbosch Garden are not liable or do not accept any responsibility for any lost, stolen or damage done to any guest’s property.
Any damage to the property or its content should be reported immediately upon arrival to Owners.
Failing to do so, guests will be held liable for any damage to the property or content.
No parties or events.
For safety reasons - no guests allowed at all.
The Owners private residence is off limits for all guests.
The Pool is private and not safe guarded – no guest allowed close to pool.
No smoking is permitted in inside or outside – this is a SMOKE FREE property.
Cash security deposit is payable on arrival. This will be refunded to credit card or EFT 48 business hours after departure if all in order.
The following terms and conditions will apply to all bookings.
We ask that you take a moment to read them prior to making a booking.
Please pay attention to our deposit and cancellation policies as well as the other terms and conditions.
In these terms and conditions, which apply to all bookings, the following words shall mean:
1.1 "Agreement" means your booking confirmation read together with these Terms & Conditions;
1.2 "Guest" means the person who will be accommodated at Stellenbosch Gardens;
1.3 "SG" means Stellenbosch Gardens;
1.4 "Stellenbosch Gardens" means Blessed Ventures CC; and
1.5 “Terms & Conditions" means the terms and conditions of stay contained herein.
2 BOOKING PROCEDURE
2.1 Bookings must be made in advance. Quotations for accommodation will be based on availability as at the date and time of quoting.
2.2 Guests will receive a booking confirmation, in writing, once the booking has been secured via payment of a deposit.
3 CHARGES, DEPOSIT AND PAYMENT
3.1 Prices quoted by Stellenbosch Gardens are inclusive of all taxed where applicable.
3.2 Guests are required to make full prepayment for total accommodation costs prior to the date of arrival.
All other charges incurred during a Guest's stay may either be settled immediately or by debiting them to each room's account, in which event such account shall be settled in full on departure upon presentation of an invoice.
3.3 Bookings must be secured by payment of a percentage of the costs. Payment may be made via electronic funds transfer.
3.4 Should a person fail to pay such deposit, SG may treat the booking as having been cancelled without further notice.
3.5 Only the persons registered on the booking form are allowed to sleep in the rooms. Any unauthorised person who is found to have slept on the premises will mean terms and conditions have not been adhered to and will result in immediate eviction from your room and an additional nightly rate will be applicable for that person payable on eviction.
3.6 Terms of booking and cancellation:
3.6.1 Payment in full on receipt of invoice
3.6.2 Cancellation longer than 30 days before arrival incurs handling fee of 10% only
3.6.3 Cancellation between 14 and 30 days before arrival incurs 50% cancellation fee plus handling fee of 10%
3.6.4 Cancellation less than 14 days means no refund and full payment forfeited
3.6.5 Cash Security Deposit payable on arrival. This will be refunded to credit card or EFT 48 business hours after departure if all in order.
4 CANCELLATIONS AND NON-ARRIVALS
4.1 Cancellations to any booking must be made in writing. The Guest shall be liable for and pay to Stellenbosch Gardens a cancellation fee, the amount of which will be determined by Stellenbosch Gardens having regard to the length of notice of cancellation, the reasonable potential to find another guest between the time of receiving the cancellation notice and the time of cancelled reservation and the general practice in the SG and leisure industry.
4.2 All rooms that have been confirmed will be held until 22h00 on the scheduled date of arrival at which time SG may re-let the room without further notice, unless notified of a late arrival.
5 CHANGES TO BOOKINGS
Changes to any bookings must be made in writing. No amendments are guaranteed until written confirmation is provided by Stellenbosch Gardens. Rate variations may apply, depending on the nature of the change.
6 CHECK-IN / CHECK-OUT
6.1 Guests may check-in at any time from 15h00 on the day of arrival.
Guests must vacate their rooms by 10h00 on the day of departure (unless prior authorisation is obtained). Guests are kindly asked to make contact before departure.
6.2 Late checkouts are available upon request but are subject to availability and may incur a daily charge at SG's discretion.
7 NO SMOKING POLICY
SG and its entire premises is a non-smoking area.
SG reserves the right to remove with immediate effect and or charge an additional amount for the cleaning of the room and loss of business for 48 hours after the Guest has departed in order to clear any room of smoke before re-letting to a non-smoking Guest.
8 ILLEGAL ACTIVITIES
No illegal activities are allowed on the SG premises.
If any illegal activities are identified the guests will be asked to leave with immediate affect and the police will be contacted.
The stay with SG will be terminated without any refunds.
9 CHILDREN
9.1 SG Cottages accommodate a maximum of 2 adults per bedroom unless more are authorised with written confirmation.
Children under 1 years (as at the date of arrival) are accommodated free of charge if sharing a room with at least one full paying adult, subject to a maximum of one children per cottage. A compulsory baby sleeper cot will be supplied at an additional cost.
Children older than 1 year will be treated at adults or normal paying guests.
10 DAMAGE TO OR REMOVAL OF SG PROPERTY
10.1 Guests will be responsible for any damage caused to the SG room or any furnishings, fittings and equipment therein by any act or omission of the Guest, his/her invitees, subcontractors or guests.
10.2 Stellenbosch Gardens reserves the right to charge Guests the cost of replacing any items that are removed from SG by them without consent. The charge will be the full replacement amount of the missing item.
10.3 Should the fact that any damage has occurred or any item is missing come to light after the Guest has departed, Stellenbosch Gardens reserves the right to charge the Guest the total cost and amount Stellenbosch Gardens reserves the right to make a charge to the Guest's credit or debit card.
10.4 Stellenbosch Gardens reserves the right to take action against any Guest found to have tampered / interfered with any fire extinguishers. Guests found to have tampered with any fire fighting equipment will be charged with any costs incurred by SG due to their actions and additionally may be asked to leave SG. Should the fact that fire fighting equipment had been tampered with come to light after the guests has departed Stellenbosch Gardens reserves the right to make a charge to the Guest's credit or debit card.
11 LOST PROPERTY
If SG staff finds any personal effects, goods left behind by a Guest or any other lost property, Stellenbosch Gardens will retain such items and if an item is not reclaimed within 1 month of the Guest's departure it will be disposed of by SG at its discretion.
12 BEHAVIOUR
Stellenbosch Gardens reserves the right to judge acceptable levels of noise or behaviour of the Guest who must take all steps necessary for corrective action as requested by SG. In the event of failure to comply with management’s request, SG may terminate a booking or function immediately without being liable for any refund or compensation.
13 NO DISCRIMINATION
It is the policy of the SG not to discriminate on the grounds of race, colour, nationality, sex, marital status, age, ethnic origin or disability and as a responsible host we believe that we have a duty to our guests to protect them from inappropriate behaviour. The Guest, his/her employees, guests and sub-contractors engaged by or on behalf of the Guest are expected to adhere to this policy and SG may, without incurring any liability to the Guest, immediately remove from SG any person(s) offending against this policy. Should any actions by a Guest be deemed inappropriate, or if any inappropriate behaviour is brought to the attention of the owners, SG reserves the right, after any allegations have been investigated, to take action against the Guest.
14 USE OF FACILITIES AND OUTSIDE SERVICES
SG may in its absolute discretion refuse access to any third party service provider that the Guests bring onto the premises with prior approval.
15 PETS
Pets are not permitted.
16 SG EVENTS
Please take note that at certain times during the year SG may host functions and events, which may be considered a disturbance or an intrusion during a Guest's stay. Please contact SG should you require further information.
17 LIABILITY
17.1 All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this Agreement.
17.2 SG shall have no liability to the Guest and/or the Guest’s invitees, visitors, employees, sub-contractors or invitees for any special, indirect, consequential loss or damage unless caused by gross negligence or otherwise provided for in this Agreement. Stellenbosch Gardens’ total liability shall, wherever permitted by law, be limited to the value of this Agreement.
17.3 Unless SG is liable under clause 17.1, the Guest shall indemnify SG against any/all liability and any claims, proceedings or damages resulting or arising from or by the booking, function, the Guest, his/her invitees, visitors or any service provider engaged by the Guest.
17.4 Guests are encouraged to lock their motor vehicles and cottages at all times unattended.
SG does not accept responsibility whatsoever for damage to, or theft from or theft of, motor vehicles parked on SG premises or from cottages at SG.
The Guest is advised to have and is responsible for insurance to cover loss of baggage, personal effects and cash.
17.5 The Guest shall be responsible for any damage caused to the cottage, furnishings, utensils and equipment therein caused by or attributable to any act, omission, default or neglect of the Guest, his/her invitees, visitors or service providers engaged by SG and will pay to SG on demand the amount required to make good or remedy any such damage. For the purpose of this clause, acts or omissions of the guests, invitees, employees and/or sub-contractors shall be deemed acts of the Guest.
18 FORCE MAJEURE
18.1 Stellenbosch Gardens shall not be in breach of this Agreement if it does not provide the services under this Agreement, and it shall be entitled to cancel a booking if it is no longer able to provide the accommodation, due to one or more of the following circumstances:
18.1.1 any part of SG is closed due to fire, alteration or redecoration by order of any public authority or any reason beyond SG's control;
18.1.2 there is a failure to supply the SG with gas, electricity or water outside of SG's control;
18.1.3 SG is unable to fulfil the booking as a result of industrial action by its staff or one of its suppliers;
18.1.4 fire, lightning, explosion, riot or civil commotion, malicious damage, storm, tempest, flood, burst pipes, earthquakes, or impact resulting in SG being unable to provide the booked facilities.
By confirming your reservation you hereby agree that you have read and understand the terms and conditions stipulated above. You hereby acknowledge to all the responsibilities that will lie with you if terms and conditions are not met.
